Terms of use of the Service

§ 1 General provisions
  1. These regulations define the terms and conditions of using this Website available at the address https://mindz.it, which is operated by Mindz IT Sp. z o.o. Sp. komandytowa with its registered office in Wrocław, address: Skarbowców 23a, 53-025 Wrocław, entered into the Register of Entrepreneurs kept by the District Court for Wrocław-Fabryczna in Wrocław, the 9th Commercial Department of the National Court Register under the KRS number: KRS [National Court Register No.]: 0000657771, NIP [Tax Identification Number]: 899-280-61-23, REGON [National Registry of Economic Units]: 366310381.
  2. You can contact the Service Provider as follows:

  3. Access to the Website is free of charge. The only cost that Users incur in connection with the use of this Website is the cost of the Internet connection with the Website, which depends on the duration of the connection and the tariff applicable to the operator of the network used by the User.
  4. The Service Provider provides the Users with the terms of use free of charge, the content of which can be obtained, reproduced, and recorded at any time using the ICT system used by the User.
  5. Definitions of terms used in the regulations:
    - Contact form - a form available on the website in the Contact and Jobs page enabling contact with the Service Provider.
    - User - a natural person, legal person or an organizational unit without legal personality who uses the services provided by electronic means.
    - Website (hereinafter also referred to as the "Website") – a website operating at https://mindz.it.
    - Service Provider - Mindz IT Sp. z o.o. Sp. komandytowa, with its registered office at Skarbowców 23a, 53-025 Wrocław, entered into the Register of Entrepreneurs kept by the District Court for Wrocław-Fabrycza in Wrocław, the 9th Commercial Department of the National Court Register under the KRS number: KRS [National Court Register No.]: 0000657771, NIP [Tax IdentificationNumber]: 8992806123, REGON [National Registry of Economic Units]: 366310381.

§ 2 Types and scope of services provided electronically

The services provided electronically by the Service Provider:
  1. The Contact Form service is available to Users who have access to theWebsite, enabling them to contact the Service Provider. The service begins upon clicking the Contact tab, filling out the Contact Form by providing personal data such as first name, last name, email address, phone number, composing the message content, and clicking the Send button. The service is provided free of charge and is of a one-time nature, terminating upon the submission of the message via the Form or upon the User's earlier cessation of sending messages via the Form.
  2. The Content Browsing service allows for browsing the content posted on the Website, including projects carried out by the Service Provider.
  3. Due to the fact that the Website constitutes a ICT system managed by the ServiceProvider, the Service Provider may carry out technical and IT work aimed at expanding the Website and improving the services provided to a higher level.
  4. Aspart of the development of the Website, the Service Provider has the ability to:
    - incorporate new functionalities, as well as make changes or remove existing functionalities within the Website,
    - introduce the Website on adifferent type of device, such as mobile devices.
§ 3 Terms of providing services by electronic means
Technical requirements:
  1. The conditions for using the services of the Website are as follows:
    - having a computer, laptop or other device with Internet access,
    - having an e-mail account (e-mail),
    - Web browser: Google Chrome, Mozilla Firefox, Microsoft Edge, Safari, Opera,
    - enabling cookies and JavaScript support in the browser,
    - minimum screen resolution: 1024 x 768 pixels or higher.
  2. In case additional technical requirements other than those indicated inpoint 1 of this paragraph are necessary to use the services, the ServiceProvider will inform the User by including the technical requirements in thedescription available on the Website.
  3. Due to technological changes, the aforementioned technical requirements may be subject to change, particularly in the event that the existing software is replaced with a higher version.
  4. The Service Recipient using the Website is obliged to:
    - use the Website in accordance with its intended purpose and refrain from providing unlawful content,
    - use all content available on the Website solely for personal use,
    - refrain from engaging in activities involving the sending or posting of unsolicited commercial information (spam) within the Website,
    - refrain from engaging in actions that infringe upon the rights of third parties, violate generally accepted social norms, or undermine good morals or anyone's dignity.
§ 4 Information about specific threats related to customers' use of services provided electronically by the Service Provider
  1. The Service Provider pays special attention to the fact that the provision of services by electronic means is associated with a risk on the part of the User using the Internet.
  2. The basic threats associated with using the Internet include:
    - malware - various applications or scripts that cause harmful or malicious actions towards the User's ICT system, such as viruses, worms, trojans,
    - spyware - tracking programs that gather information about the User's actions and transmit it to the program's author,
    - hacking into the User's system using hacking tools,
    - phishing - attempting to obtain confidential information, such aspasswords, by impersonating another person,
    - spam - unwanted and unsolicited electronic messages sent simultaneously to multiple recipients, often containing advertising content,
    - cryptanalysis - the ability to detect vulnerabilities in a cryptographic system in order to break or bypass it.
  3. In order to avoid the above-mentioned threats, the User should install antivirus software on their computer or device used to connect to the Internet.The program should be regularly updated. Additionally, it is recommended thatUsers who use services provided electronically have a firewall enabled, do not open email attachments from unknown sources, and regularly scan the entire system with antivirus software.
  4. Any unusual signs of theWebsite's operation, especially a different appearance of the Website, previously unseen messages, notifications, images, etc., without prior notice from the Service Provider to Users regarding the possibility of such incidents, may indicate an attempt of unlawful activity by third parties. In such circumstances, the Service Provider recommends immediately discontinuing the use of the Website and notifying the Service Provider of the incident.
§ 5 Complaints regarding the provision of electronic services
  1. Complaints related to the operation of the Website may be submitted electronically to thee-mail address: office@mindz.it or in writing to the following address: Mindz IT Sp. z o.o. Sp. komandytowa, address: Skarbowców 23a, 53-025 Wrocław, Poland.
  2. In the complaint notification, please provide the following information: the name and surname of the person making the complaint, correspondence address, email address, a description of the problem that forms the basis of the complaint and indicate the preferred method of receiving a response to the complaint (via mail or email).
  3. The Service Provider shall respond to the complaint within 14 days from its receipt by sending an appropriate response in accordance with the method chosen by the User.
§ 6 Personal data protection

  2. The Data Administrator can be contacted as follows:

  3. The Data controller declares that they have necessary IT systems and implement appropriate procedures to ensure protection against unauthorized access by third parties to personal data in accordance with the requirements of the GDPR.
  4. Detailed rules regarding the processing of personal data are available in the Privacy Policy section. The Privacy Policy contains information about the processing of personal data by the data controller, including legal bases, purposes, and retention periods of personal data, as well as the rights of individuals whose data is processed, and information about cookies.
§ 7 Final provisions
  1. In matters not covered by these regulations, the provisions of generally applicable Polish law shall apply, in particular the Act of 18 July 2002 on the provision of electronic services (the Journal of Laws of 2020, item 344), theAct of 23 April 1964 Civil Code (the Journal of Laws of 2020, item 1740, 2320) and other relevant provisions of generally applicable law.
  2. The copyrights and intellectual property rights to the Website as a whole and its individual elements, including content, graphics, patterns and signs available on the Website, belong to the Service Provider or other authorized third parties, are protected by copyright and other provisions of generally applicable law.
  3. The Service Provider makes every effort to ensure the proper functioning of the Website and the possibility of using the services provided electronically. Due to external factors beyond the control of the ServiceProvider (e.g. DDoS attacks), errors and technical failures that prevent or limit the functioning of the Website in any way are possible to occur. In sucha case, the Service Provider takes all possible measures to ensure that thenegative effects of such events are limited as much as possible.
  4. The Service Provider informs the Users about any errors and technical failures referred to in point 3 of this section and the estimated time of their removal.
  5. In addition to interruptions caused by errors and technical failures, other technical breaks may occur during which the Service Provider takes actions to modernize the Website. The Service Provider informs Users about planned technical breaks in advance, providing information about the expected duration of the planned technical break.
  6. The regulation is effective from 16 May 2023.
